The ground rules

Terms of service

These terms govern merchant access to DirectSnail’s Shopify application, website, design tools, billing features, printing, and mailing services.

1. Agreement

By installing, accessing, or using DirectSnail, you agree to these Terms of Service (“Terms”) on behalf of yourself and the business you represent. If you do not agree, do not use the service. You must have authority to bind the relevant business and be legally able to enter a contract.

2. The service

DirectSnail lets Shopify merchants create or upload postcard designs, select audiences from their Shopify customer data, purchase mail credit, submit campaigns for printing and postal delivery, follow delivery events, and review campaign reporting. Certain features may be identified as beta, limited, or not yet available.

We may improve, change, suspend, or discontinue parts of the service. We will use reasonable efforts to provide notice when a material change negatively affects active paid use.

3. Your account

You are responsible for your Shopify account, authorized users, store configuration, and activity performed through your account. Keep credentials secure and notify us promptly of suspected unauthorized access. Shopify’s own terms also apply to your use of Shopify.

4. Your audiences and legal responsibilities

You decide who receives a campaign and act as the controller or business for the customer information supplied through Shopify. You represent that:

  • You collected and use recipient information lawfully and have the right to direct us to process it.
  • Your campaigns comply with applicable privacy, consumer-protection, advertising, postal, promotion, and industry rules.
  • You will honor consent, suppression, and opt-out obligations and will not deliberately bypass DirectSnail suppression controls.
  • You will not use DirectSnail to send deceptive, discriminatory, unlawful, threatening, or harmful content.

5. Artwork and content

You retain ownership of artwork and content you provide. You grant DirectSnail and its service providers a limited license to host, reproduce, modify for technical formatting, print, and mail that content solely to provide the service.

You represent that you own or have permission to use your content, including trademarks, images, offers, and promotional claims. You must not place sensitive personal information where it will be visible on an exposed postcard. Automated print checks reduce production errors but do not replace your final review and approval.

6. Pricing, Shopify billing, and mail credit

Current prices are shown on the pricing page and in the application before a campaign is submitted. Applicable charges are processed through Shopify billing. You select a 30-day usage limit, and Shopify will not permit DirectSnail usage charges beyond that approved limit.

Purchased mail credit remains available to your account until used, refunded where required, or otherwise addressed when your account closes. A postcard becomes non-cancellable and non-refundable once it has been accepted for production by the print provider because the printing and postage cost has already been incurred. Taxes may apply.

7. Samples, delivery, and provider services

Complimentary sample allowances are subject to reasonable-use limits shown in the application. Printing and delivery are performed by third-party providers and postal carriers. Delivery dates and tracking events are estimates, not guarantees. Weather, address quality, carrier operations, and events outside our control may delay or prevent delivery.

If a production error appears to have been caused by DirectSnail or its print provider, contact support with the campaign and affected pieces. We will investigate and determine an appropriate remedy based on the circumstances.

8. Reporting and attribution

Campaign reporting is informational. Delivery scans come from fulfillment and postal providers and may be delayed or incomplete. Revenue attribution depends on Shopify order data, campaign offer codes, attribution windows, and any selected holdout group. Reporting is not a promise of financial performance.

9. Privacy and data processing

Our Privacy Policy describes how we handle information. When DirectSnail processes Shopify customer personal data for a merchant, the Data Processing Addendum forms part of these Terms.

10. Acceptable use and enforcement

You may not probe or disrupt the service, defeat access or spending controls, misuse another merchant’s data, submit malicious files, impersonate another person or business, use the service for unlawful list acquisition, or help someone do any of these things. We may reject content, pause a campaign, or suspend access when reasonably necessary to protect recipients, merchants, providers, or the service.

11. Intellectual property

DirectSnail and its software, templates, brand, documentation, and original site content are owned by DirectSnail or its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the service for your business while your account remains in good standing. Feedback may be used without restriction or obligation.

12. Disclaimers

To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

13. Limitation of liability

To the maximum extent permitted by law, DirectSnail will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data. DirectSnail’s aggregate liability arising from the service will not exceed the amount you paid to DirectSnail during the twelve months before the event giving rise to the claim. These limits do not apply where prohibited by law.

14. Indemnity

You will defend and indemnify DirectSnail and its personnel against third-party claims arising from your audiences, content, offers, unlawful instructions, violation of these Terms, or infringement of another person’s rights, except to the extent caused by DirectSnail’s own breach or misconduct.

15. Suspension and termination

You may uninstall the app at any time. We may suspend or terminate access for material breach, unlawful activity, risk to the service or its users, nonpayment, or as required by Shopify or law. Terms that by their nature should survive termination—including payment, ownership, disclaimers, liability limits, and dispute provisions—will survive.

16. General terms

You may not assign these Terms without our consent, except with a permitted transfer of your business. We may assign them as part of a merger, financing, reorganization, or sale. Neither party is liable for delay caused by events beyond reasonable control. If a provision is unenforceable, the remainder stays effective. Failure to enforce a provision is not a waiver.

17. Changes and contact
